    I think what you mean is that you have two ISPs. One provides your internet connectivity and the other provides your web hosting.

    This doesn't really effect the argument tho'. If your CGI program is found and used by spammers then you will be blacklisted by your (web hosting) ISP. Worse than that, many other ISPs will blacklist your ISP as being a source of spam. This will make you very unpopular with other users of your ISP as suddenly their (legitmate) emails will be refused by other ISPs.

    ISP stands for Internet Service Provider. This is not limited to companies that provide Internet access, but also includes hosting providers. Your "host" really is an ISP, whether you like it or not.

    Unless, of course, they do not provide any service.
