Question: Why would that warrant a cease && desist?

If you're using the site properly, then you probably will be okay, in fact if all you're doing is filling out a form, then they will more-than-likely never know. If you're going to try and spam through, cause DoS, or hack-and-slash your way in, then you'll probably be in trouble.
