IANAL but I would expect that if they did that then Perlmonks can just point to Dungeons and Dragons and claim that it is an established term. Besides which it isn't a software product at all and therefore cannot infringe on any trademarks that Microsoft might be trying to aquire. Then vroom can countersue for a frivolous lawsuit... :-)

Considering the relative size of the pockets, Microsoft would stand to lose far more than they possibly have to gain...
